Terms & Conditions

Buka Jalan Travelplanner (“Buka Jalan”, “we”, “us”, or “our”) is a travel planning and advisory business based in The Netherlands.

2. Scope of Services

Buka Jalan provides:

  • Personalized travel planning
  • Custom travel itineraries
  • Destination research and advisory
  • Booking assistance for selected local services in Indonesia
  • Digital travel guides and downloadable travel materials

We focus on curated, culturally immersive and non-touristic travel experiences.

3. Nature of Our Role

Buka Jalan is not:

  • A travel agency
  • A tour operator
  • A package holiday provider
  • An airline
  • A transport or accommodation provider

We do not operate travel services ourselves.

We provide independent advice and planning services

4. Booking Assistance

We may assist with arranging bookings for:

  • Local tour guides
  • Ground transportation
  • Ferry or domestic transport tickets
  • Accommodation
  • Activities and excursions

We do not book international flight tickets.

When booking assistance is provided:

  • Buka Jalan acts solely as an intermediary.
  • The contract for the service is concluded directly between you and the third-party provider.
  • The third-party provider is solely responsible for delivering the service.

Buka Jalan does not sell package holidays under EU travel legislation.

5. Pricing & Payment

  • All prices are stated in EUR unless otherwise indicated.
  • Planning fees must be paid in full before work begins, unless agreed otherwise in writing.
  • Payments for third-party services may be paid directly to providers or collected by Buka Jalan strictly as a payment facilitator.
  • Late payments may result in suspension of services.

6. Digital Travel Guides & Downloadable Products

Buka Jalan offers digital travel guides and downloadable travel materials (“Digital Products”).

Delivery

Digital Products are delivered electronically via email or download link after successful payment.

It is your responsibility to provide a correct email address.

No Right of Withdrawal

In accordance with EU consumer law, digital content that is delivered immediately and not supplied on a tangible medium is non-refundable once access or download has started.

By purchasing a Digital Product, you expressly agree that:

  • Delivery begins immediately after purchase.
  • You waive your statutory right of withdrawal.

License & Intellectual Property

All Digital Products, itineraries, travel plans, and written materials remain the intellectual property of Buka Jalan.

Purchase grants a personal, non-transferable, non-commercial license for individual use only.

Materials may not be:

  • Resold
  • Shared publicly
  • Reproduced
  • Distributed
  • Used for commercial purposes

Unauthorized distribution may result in legal action.

7. Cancellations & Refunds (Services)

Due to the personalized nature of travel planning:

  • Planning fees are non-refundable once work has commenced.
  • If cancelled before work begins, a partial refund may be granted at our discretion, minus administrative costs.
  • Third-party cancellation policies apply separately and are outside our control.

8. Client Responsibilities

You are responsible for:

  • Providing accurate and complete information
  • Verifying booking details before confirmation
  • Ensuring passports, visas, and entry requirements are valid
  • Arranging adequate travel and medical insurance
  • Complying with local laws and regulations

All travel decisions are made at your own risk.

9. Third-Party Providers

Buka Jalan is not liable for:

  • Service failures
  • Cancellations or schedule changes
  • Insolvency of providers
  • Acts or omissions of third parties
  • Injury, illness, loss, theft, or damage during travel

Any complaints regarding services must be addressed directly to the respective provider.

10. Travel Risk Disclaimer

Travel involves inherent risks including:

  • Illness or injury
  • Political instability
  • Natural disasters
  • Weather conditions
  • Transportation disruptions

We strongly recommend comprehensive travel insurance.

11. Limitation of Liability

To the fullest extent permitted by law:

  • Our liability is limited to the amount paid for our planning services.
  • We are not liable for indirect or consequential damages.
  • We are not responsible for losses arising from third-party services.

12. Force Majeure

We are not liable for delays or failure to perform due to circumstances beyond our reasonable control, including natural disasters, pandemics, government actions, or civil unrest.

13. Governing Law

These Terms & Conditions are governed by the laws of The Netherlands.

Any disputes shall be submitted to the competent court in The Netherlands.
